Eligibility
Is medical aid in dying an option for me?
New Mexico's law is carefully written to protect patients. Here is who it is for — and, just as importantly, who it is not for.
You may qualify if all of these are true
- You are an adult (18 or older) and a resident of New Mexico.
- You have a terminal illness with a prognosis of six months or less to live, confirmed by qualified clinicians.
- You are mentally capable of making and communicating your own health-care decisions.
- You are making this request voluntarily, free of pressure from anyone.
- You are physically able to self-administer (take) the medication yourself.
This is not the right path if
- You are seeking help during a mental-health crisis. Aid in dying is not for emotional distress or suicidal crisis — please call or text 988 to reach caring help right now.
- Your illness is not terminal, or your prognosis is longer than six months.
- You are unable to make your own medical decisions, or someone else is directing the request.
- You would need another person to administer the medication for you.
